Artsakh NA Standing Committee on State and Legal Affairs Sitting Took Place

November 23, the sitting of the NA Standing Committee on State and Legal Affairs took place, which was led by the Chair of the committee S. Aghajanyan.

The first issue on the agenda was the discussion of the draft law «On Making Amendments to the Law "On the Administrative Territorial Division of the Nagorno Karabakh Republic"», presented by the Minister of Territorial Administration and Infrastructure of the Republic of Artsakh, Hayk Khanumyan.

The proposed amendment envisages a legal clarification of the law on the communities beyond the control of the Republic Artsakh as a result of the hostilities unleashed against the Artsakh Republic on September 27, 2020.

The draft was approved by the committee.

The Minister of Justice of the Republic of Artsakh. Jirayr Mirzoyan was authorized to present the package of laws.

The bill proposes that the Compulsory Enforcement Service should now ensure not only the execution of judicial acts, but also the execution of irrevocable administrative acts.

A number of amendments suggest that Enforcement Service personnel should be given priority in the appointment of managers or leadership teams followed by officers of the armed forces, national security, police, prosecutors, Investigative Committee, rescue and prison services (including former officers) who meet the requirements for the appointment of compulsory enforcement officers to this position, as well as in the event of a vacancy for the leading group of compulsory enforcement officers or inspectors in the Compulsory Enforcement Service. It will initially be filled out on a non-competitive basis by appointing this officer as a qualified person to be appointed to the position for compulsory bailiffs.

The proposed amendment removes the income declaration of compulsory executors from the law, as it is already regulated by the Law on Declaration of Property and Income of High-ranking Officials.

The financial security of compulsory executors has also been removed from the framework of the law as it is defined by the Law on Remuneration of Public Officials. Based on the principles established by the Law on Remuneration of Public Officials (…ensuring reasonable ratios of basic and additional salaries, adequate remuneration for adequate work and experience, promotion of the desire of public servants to hold higher positions during their service…), it is proposed to make changes in the law due to the peculiarities of the Compulsory Enforcement Service by the decision of the Government of the Artsakh Republic, envisaging the cases of the bonus paid to the employees of the Compulsory Enforcement Service, the possibility of defining the procedure, establishing new social guarantees for the employees of the Compulsory Service.

The bill was adopted by the committee with 4 votes in favor.

The speakers gave clarifications to the issues raised by the deputies.

The presented bills will be discussed at the forthcoming regular sitting of the National Assembly.

The NA President Artur Tovmasyan and the NA Vice-President Gagik Baghunts were present at the sitting.
